Terms & Conditions
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and HoSko, LLC ("HoSko," "we," "our," or "us") governing your access to and use of GetHoSko.com, the HoSko application, and related products and services (collectively, the "Service").
By creating an account, purchasing a subscription, accessing, or using HoSko, you agree to these Terms and acknowledge that you have received or had access to the separate HoSko Privacy Policy. If you do not agree to these Terms, do not use HoSko.
1. Adults Only
HoSko is exclusively for adults who are 18 years of age or older. By creating an account or using HoSko, you represent and warrant that you are at least 18 years old and legally capable of entering into these Terms.
No person under 18 may create an account, use HoSko, or knowingly be entered, depicted, rated, reviewed, or otherwise included in User Content.
If HoSko becomes aware of content involving a minor, HoSko may immediately remove or restrict the content, suspend or terminate associated accounts, preserve relevant information where appropriate, and make reports to appropriate authorities when required or permitted by law.
2. What HoSko Is
HoSko is a personal recordkeeping, rating, comparison, and decision-support application designed to help adult users privately evaluate their own lawful dating, social, travel, and nightlife experiences.
HoSko may allow users to record and compare factors including personal impressions, compatibility, experiences, preferences, expenses, locations, and other information selected by the user.
HoSko may use information entered by a user to generate calculations, ratings, rankings, statistics, comparisons, or a personalized HoSko Score.
HoSko is intended to complement personal judgment by providing a structured method for reviewing an experience after it occurs.
3. What HoSko Is Not
HoSko is not a dating service, matchmaking service, escort service, prostitution service, sexual-services marketplace, employment agency, background-check service, or provider of women, dates, escorts, or companions.
HoSko does not arrange introductions between users and other individuals. HoSko does not arrange, negotiate, solicit, advertise, facilitate, or process payments for sexual services.
Individuals entered into HoSko are not employees, contractors, agents, representatives, inventory, products, or service providers of HoSko.
HoSko does not endorse or recommend any particular individual and does not guarantee another person's identity, character, intentions, honesty, safety, health, availability, compatibility, or suitability.
4. Personal Decision-Support Tool
HoSko is designed to help users evaluate experiences that have already occurred and make their own decisions regarding future interactions.
The HoSko Score and other calculations are informational tools generated from information supplied by the user and HoSko's methodology. A HoSko Score does not represent an objective determination of another person's human worth, character, morality, safety, honesty, desirability, or suitability for a relationship.
The user remains solely responsible for deciding whether to meet, date, continue dating, communicate with, travel with, provide money to, or otherwise interact with another person.
5. Private Personal Use
Unless HoSko expressly provides a feature intended for another purpose, information recorded about another individual through HoSko is intended for the account holder's private, personal use.
You may not use HoSko to create a public directory, public ranking system, public review database, or publicly searchable collection of identifiable individuals.
You may not systematically publish, redistribute, sell, license, or commercially exploit HoSko records concerning other individuals.
Nothing in these Terms prevents lawful disclosure when required by law or the exercise of rights that cannot legally be restricted.
6. No Public Dissemination or Harassment
You may not use screenshots, exports, reports, photographs, ratings, scores, notes, or other HoSko content to harass, threaten, intimidate, shame, blackmail, extort, stalk, exploit, or unlawfully embarrass another person.
You may not intentionally publish another person's private or sensitive information obtained through HoSko in a manner that violates applicable law or that person's legal rights.
HoSko may restrict or terminate accounts used to weaponize information concerning another individual.
7. User Accounts and Security
You agree to provide accurate information when establishing an account and to maintain the security and confidentiality of your account credentials. You are responsible for activity occurring through your account to the extent permitted by applicable law.
You may not sell, rent, sublicense, transfer, or provide another person unauthorized access to your HoSko account. You must promptly notify HoSko if you reasonably believe your account has been compromised.
8. User-Generated Content
HoSko may permit users to enter or upload photographs, nicknames, ratings, comments, notes, expenses, locations, descriptions, impressions, and other information ("User Content").
You retain ownership of User Content to the extent you have lawful ownership rights in that content. By submitting User Content, you grant HoSko a limited, non-exclusive license to host, store, reproduce, process, transmit, and display that content only as reasonably necessary to operate, maintain, secure, improve, and provide the Service, comply with applicable law, respond to legitimate complaints, and enforce these Terms.
You represent and warrant that you have the legal right to possess, submit, and use your User Content for the purposes for which it is submitted. The technical ability to enter information into HoSko does not constitute authorization from HoSko to collect, possess, upload, or process that information unlawfully.
9. Information About Other Individuals
HoSko may allow users to privately record information concerning other adults. You are responsible for ensuring that your collection, possession, submission, storage, and use of information concerning another person is lawful.
Whenever reasonably possible, use a nickname or non-identifying label rather than another person's full legal name. Unless expressly permitted by HoSko and lawful under the circumstances, you must not submit another person's:
- Government identification number
- Financial account information
- Password or authentication credentials
- Home address
- Private telephone number
- Private email address
- Precise real-time location
- Confidential employment information
- Medical records
- Other highly sensitive information unnecessary to HoSko's intended functionality
Your acceptance of these Terms does not constitute consent on behalf of another person whose information you enter.
10. Sensitive Personal Information
Some information concerning another individual may receive heightened protection under applicable privacy law. You may not use HoSko to create unnecessary records concerning another person's medical condition, government identifiers, financial accounts, sexual history, or other specially protected information.
Where applicable law requires another individual's consent or another lawful basis before particular information may be collected, stored, or otherwise processed, you are responsible for complying with that requirement with respect to your own conduct.
HoSko may restrict fields, remove information, anonymize information, or prohibit categories of information where reasonably necessary for privacy, safety, legal, or operational purposes.
11. Ratings, Opinions, and Accuracy
Ratings, notes, descriptions, scores, and other User Content may represent the user's subjective impressions and are not independently verified merely because they are stored by HoSko.
You may express lawful opinions concerning your own experiences. You may not knowingly enter materially false statements of fact concerning another individual or use HoSko to create defamatory, fraudulent, threatening, malicious, or unlawfully invasive records.
HoSko may restrict, remove, anonymize, or block information when reasonably necessary to respond to legitimate privacy, safety, legal, intellectual-property, or content complaints.
12. Photographs and Likenesses
You may upload a photograph or likeness of another adult only when you have a lawful right to possess and use that image for the intended purpose. HoSko prohibits:
- Photographs depicting anyone under 18
- Nude or sexually explicit photographs
- Non-consensual intimate imagery
- Images obtained or distributed unlawfully
- Images used for blackmail, exploitation, stalking, threats, or harassment
- Images that violate another person's privacy, copyright, publicity, or other legal rights
HoSko may remove or restrict access to photographs following a legitimate complaint or where HoSko reasonably believes the image violates these Terms or applicable law.
13. Rights of Individuals Entered Into HoSko
An individual does not need to be a HoSko user to report content concerning that individual. If another person reasonably claims that her or his photograph, likeness, identity, or personal information has been entered into HoSko unlawfully, HoSko may investigate the complaint and take appropriate action.
Depending upon applicable law and the circumstances, HoSko may remove, correct, anonymize, block, restrict, or delete qualifying information. HoSko may request information reasonably necessary to verify identity, identify the applicable content, prevent fraudulent removal requests, and protect other individuals' rights.
Privacy requests should be submitted to privacy@GetHoSko.com. Safety and content complaints should be submitted to safety@GetHoSko.com.
14. No Solicitation or Contact Service
HoSko does not represent that any person entered into the Service is available or interested in being contacted, dated, solicited, hired, or otherwise approached.
A profile, rating, photograph, or record appearing within a user's account does not constitute an advertisement or invitation from the individual depicted. HoSko does not provide authorization to contact another person.
15. Prohibited Conduct
You may not use HoSko to engage in, facilitate, promote, solicit, organize, or assist:
- Human trafficking
- Sexual exploitation
- Coercion
- Non-consensual sexual activity
- Sexual activity involving minors
- Child sexual exploitation or abuse material
- Non-consensual intimate imagery
- Stalking
- Harassment
- Threats
- Extortion or blackmail
- Doxxing
- Fraud
- Identity theft
- Impersonation
- Unlawful surveillance
- Unauthorized access to accounts, devices, or systems
- Unlawful discrimination
- Illegal transactions
- Unlawful prostitution or commercial sexual activity
- Purchase or sale of illegal goods or services
- Any other activity prohibited by applicable law
16. No Marketplace for Sexual Services
HoSko may not be used to advertise, solicit, arrange, negotiate, book, purchase, sell, or facilitate illegal sexual services.
HoSko does not receive commissions or transaction fees from sexual activity or commercial sexual transactions. The ability to record a user's own lawful expenses or experiences does not convert HoSko into a marketplace or indicate HoSko's endorsement of the underlying activity.
17. Personal Safety
Meeting, dating, or socializing with another person involves risks that technology cannot eliminate. HoSko does not conduct criminal background checks, identity verification, medical screening, or other investigations of individuals merely because information concerning them has been entered into HoSko, unless expressly stated for a particular feature.
Users should exercise independent judgment concerning personal safety, transportation, alcohol consumption, financial decisions, sexual health, travel, meetings, and interactions with others. Nothing displayed by HoSko constitutes a safety certification or guarantee.
18. Expenses and Economic Analysis
HoSko may permit users to record expenses associated with their own lawful dating, travel, social, or nightlife experiences. HoSko may combine expense information with other user-selected factors to assist the user in evaluating an experience or future decision.
HoSko evaluates the user's experience and economic decision. HoSko does not assign a monetary value to a human being. Any displayed cost, value, score, efficiency, comparison, or similar metric refers to the user's experience, spending, preferences, or decision criteria and should not be interpreted as a statement of another person's financial or human worth.
19. Currency Conversions
HoSko may provide currency conversions, estimates, or calculations for convenience. Currency rates fluctuate and may be obtained from third parties, cached, delayed, rounded, or otherwise differ from rates actually available through banks, payment processors, card issuers, currency exchanges, or other providers. Currency information is informational only and is not guaranteed to be current or exact.
20. HoSko Scores and Algorithmic Outputs
HoSko Scores, rankings, calculations, comparisons, recommendations, and other outputs are generated using user-entered information and HoSko's methodologies. Outputs are inherently dependent upon the accuracy and completeness of information supplied by the user.
HoSko does not warrant that an output is objectively correct or that following an output will produce any particular relationship, dating, financial, social, or personal result. Users should treat HoSko outputs as decision-support information rather than factual determinations or professional advice.
21. Privacy
HoSko maintains a separate Privacy Policy explaining HoSko, LLC's collection, processing, disclosure, retention, security, and handling of personal information. The Privacy Policy is incorporated into these Terms by reference only to the extent appropriate and does not transform these Terms into a privacy notice.
Where these Terms address a user's obligations concerning another person's information, those contractual obligations are separate from HoSko's own obligations under applicable privacy law.
22. Philippine Use and Applicable Law
Users accessing HoSko from or using HoSko in connection with individuals located in the Philippines must comply with applicable Philippine law. Certain personal information may receive heightened protection under Philippine law.
Nothing in these Terms authorizes a user to collect, store, disclose, or otherwise process information in violation of the Philippine Data Privacy Act of 2012 or other applicable law. HoSko's own practices concerning personal information are addressed separately in the HoSko Privacy Policy.
23. Copyright and Intellectual-Property Complaints
HoSko respects intellectual-property rights. Users may not upload photographs, images, text, or other materials that infringe another person's copyright or other intellectual-property rights.
HoSko may remove or disable access to material in response to a valid copyright complaint and may terminate accounts of repeat infringers in appropriate circumstances. Copyright complaints should identify the copyrighted work, the allegedly infringing material, information reasonably sufficient to locate the material, contact information for the complaining party, and the representations required by applicable copyright law.
HoSko may establish and publish separate DMCA procedures and designated-agent information.
24. Repeat Infringers and Repeat Violators
HoSko may suspend or terminate accounts belonging to users who repeatedly violate copyrights, privacy rights, these Terms, or applicable safety and content rules. HoSko may consider the nature, frequency, severity, circumstances, and reliability of complaints when determining appropriate action.
Nothing requires HoSko to restore an account where continued access presents a material legal, privacy, security, or safety risk.
25. Subscriptions and Billing
Certain HoSko features require a paid subscription. Before purchase, HoSko will disclose the applicable price, billing frequency, material subscription terms, and available cancellation method. Unless otherwise disclosed, subscriptions automatically renew until canceled.
By purchasing an automatically renewing subscription, you authorize HoSko or its payment processor to charge the applicable subscription fee and taxes using your selected payment method at each renewal.
HoSko will provide an easy-to-use online cancellation mechanism as required by applicable law. Cancellation stops future renewal charges but ordinarily does not retroactively refund amounts properly charged for the current subscription period, except where required by applicable law or expressly provided by HoSko.
26. Annual and Extended Subscription Renewals
Where required by applicable law, HoSko will provide advance notice before an annual or other qualifying extended subscription automatically renews. The notice may include the renewal date, renewal price, material renewal terms, and instructions for cancellation. HoSko may provide more consumer-friendly notice or cancellation procedures than legally required.
27. Free Trials and Promotional Offers
HoSko may offer free trials, promotional pricing, introductory pricing, discounts, or other offers. Specific terms applicable to an offer will be disclosed when presented.
If a free or discounted period converts to a paid subscription, HoSko will disclose the applicable price, billing frequency, conversion terms, and cancellation method as required by applicable law.
28. Refunds
Except where expressly stated during purchase or required by applicable law, properly charged subscription fees are non-refundable. Nothing in these Terms eliminates refund, cancellation, chargeback, or consumer rights that cannot legally be waived.
29. Account Cancellation and Data Following Closure
Users may discontinue use of HoSko and cancel paid subscriptions through the cancellation method provided by HoSko. Canceling a subscription and requesting deletion of an account or personal information are separate actions unless HoSko expressly states otherwise.
Following account closure, HoSko may delete, anonymize, retain, or restrict information in accordance with the HoSko Privacy Policy, applicable law, legitimate recordkeeping requirements, dispute-resolution needs, security requirements, fraud prevention, and legal obligations.
30. Electronic Communications
By creating a HoSko account, you consent to receive electronic communications reasonably necessary to administer the Service, including account notices, receipts, subscription notices, security communications, legal notices, privacy communications, and service-related messages.
Marketing communications will be handled in accordance with applicable law and available communication preferences. You are responsible for maintaining a current email address associated with your account.
31. Affiliates and Promotional Relationships
HoSko may work with affiliates, influencers, content creators, or other marketing partners. Such parties are independent from HoSko unless expressly stated otherwise.
Affiliates and promotional partners must make legally required disclosures concerning compensated relationships and may not make unauthorized, deceptive, or misleading representations about HoSko. HoSko is not responsible for unauthorized representations independently made by third parties except to the extent responsibility cannot lawfully be excluded.
32. HoSko Intellectual Property
HoSko, LLC and its licensors retain all rights in HoSko's software, website, design, interfaces, branding, trademarks, logos, graphics, proprietary methodologies, scoring systems, algorithms, databases, and other intellectual property, excluding User Content lawfully owned by users or third parties.
The HoSko name, HoSko Score, HoSko branding, and related marks may not be copied, reproduced, imitated, or commercially used without authorization. Subject to these Terms, HoSko grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful personal purposes.
33. Prohibited Commercial and Technical Use
Unless expressly authorized by HoSko, you may not:
- Resell access to HoSko
- Scrape or systematically extract HoSko data
- Create unauthorized databases using HoSko content
- Reverse engineer the Service except where applicable law expressly permits it
- Copy or reproduce HoSko's proprietary scoring methodology
- Circumvent security or access controls
- Use unauthorized automated systems to access HoSko
- Use HoSko technology or protected content to create a competing commercial service
34. Third-Party Services
HoSko may integrate with or link to third-party payment processors, hosting providers, analytics providers, maps, communications services, currency-data providers, or other services. Third-party services may be governed by separate terms and privacy policies.
HoSko does not control independent third-party services and is not responsible for their conduct except to the extent required by applicable law.
35. No Professional Advice
HoSko provides personal information-management and decision-support tools. HoSko does not provide legal, financial, medical, psychological, immigration, security, tax, investment, or professional relationship advice. Users should obtain appropriate professional advice when circumstances warrant it.
36. Service Availability and Changes
HoSko may modify, update, add, remove, suspend, or discontinue features. HoSko does not guarantee uninterrupted or error-free availability. Access may be temporarily suspended for maintenance, security, technical problems, legal requirements, product changes, or other legitimate operational reasons.
37. Account Suspension and Termination
HoSko may suspend, restrict, or terminate an account when HoSko reasonably believes the user has materially violated these Terms, repeatedly violated the rights of others, created a safety or security risk, engaged in fraudulent activity, violated applicable law, abused the Service, or exposed HoSko or another person to material legal harm. HoSko may take immediate action where circumstances reasonably require it.
38. Disclaimer of Warranties
To the maximum extent permitted by applicable law, HoSko is provided on an "as is" and "as available" basis. HoSko, LLC disclaims express and implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent such warranties may lawfully be disclaimed.
HoSko does not warrant the accuracy of user-submitted information, HoSko Scores, ratings, calculations, currency conversions, comparisons, or other outputs. HoSko does not warrant that use of the Service will produce any particular dating, relationship, financial, social, travel, or personal result.
Nothing in these Terms excludes warranties or consumer protections that cannot legally be waived.
39. Limitation of Liability
To the maximum extent permitted by applicable law, HoSko, LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of HoSko.
HoSko is not responsible for the independent actions of individuals users choose to meet, date, communicate with, travel with, provide money to, or otherwise interact with. Nothing in these Terms limits liability that applicable law does not permit to be limited or excluded.
40. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless HoSko, LLC and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, costs, and reasonable expenses arising from your unlawful User Content, material violation of these Terms, infringement or violation of another person's rights, or unlawful use of the Service. This provision does not require indemnification where prohibited by applicable law.
41. Governing Law
These Terms shall be governed by the laws of the State of Idaho, United States, without regard to conflict-of-law principles, except where mandatory laws of another jurisdiction apply and cannot legally be waived. Nothing in these Terms deprives a consumer or data subject of mandatory legal rights.
42. Dispute Resolution and Venue
Before commencing formal legal proceedings, you and HoSko agree to make a reasonable good-faith effort to resolve disputes informally. A user may initiate informal dispute resolution by contacting HoSko and describing the dispute.
Unless applicable law requires otherwise, legal proceedings concerning these Terms shall be brought in a court of competent jurisdiction located in Ada County, Idaho. Nothing in this section prevents either party from seeking emergency or injunctive relief where legally appropriate or exercising rights that cannot lawfully be waived.
43. Assignment and Change of Control
You may not assign or transfer your rights or obligations under these Terms without HoSko's prior written consent. HoSko may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or transfer of the HoSko business, subject to applicable law.
Any transfer of personal information associated with such a transaction remains subject to applicable privacy law and the HoSko Privacy Policy.
44. Force Majeure
HoSko will not be responsible for delay or failure to perform caused by circumstances reasonably beyond its control, including natural disasters, internet or telecommunications failures, governmental actions, war, civil disturbances, labor disputes, power failures, cybersecurity events affecting third parties, infrastructure failures, or failures of critical service providers, except where applicable law provides otherwise.
45. No Agency or Partnership
Use of HoSko does not create an employment, agency, partnership, joint venture, fiduciary, brokerage, matchmaking, or other similar relationship between you and HoSko. HoSko does not act as your representative in interactions with another person.
46. Waiver
HoSko's failure to enforce a provision of these Terms does not waive HoSko's right to enforce that provision later. A waiver concerning one violation does not constitute a waiver concerning another violation.
47. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible and the remaining provisions will remain in effect.
48. Survival
Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, User Content licenses to the extent required for lawful retention, disclaimers, limitations of liability, indemnification, dispute resolution, and accrued rights and obligations.
49. Changes to These Terms
HoSko may periodically update these Terms to reflect changes in the Service, business practices, technology, or applicable law. The Last Updated date identifies the most recent version. Where a change materially affects users' rights or obligations, HoSko will provide additional notice or obtain consent where required by applicable law.
50. Entire Agreement
These Terms, together with any additional terms expressly presented and accepted for a particular HoSko feature or purchase, constitute the agreement between you and HoSko regarding use of the Service. The HoSko Privacy Policy is a separate privacy notice governing HoSko's handling of personal information.
