Privacy Policy
HoSko, LLC ("HoSko," "we," "our," or "us") respects individual privacy and is committed to responsibly handling personal information. This Privacy Policy explains what information HoSko collects or processes, how we use and disclose information, how information is protected and retained, and the privacy rights and choices available to users and other individuals whose personal information may be processed through HoSko.
HoSko is intended exclusively for adults 18 years of age or older. This Privacy Policy is intended to address applicable privacy requirements in the United States and the Philippines, including, where applicable, the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, and applicable regulations, circulars, advisories, and guidance issued by the National Privacy Commission of the Philippines ("NPC").
Your dates are your business.
HoSko is designed with privacy and discretion in mind.
We collect only the account and payment information reasonably necessary to provide, maintain, protect, and improve the service. We do not route or store this data through any app store. We don't care who you see or what you do with it — and we don't share your personal data with anyone.
Your ratings, spending information, notes, scores, and comparisons are private to your account. They are not published, shared with other users, or made available through a public searchable database.
- We don't sell your private dating information.
- We don't contact the people you rate.
- We don't require you to use their real names.
- We don't create public profiles from your entries.
Use a nickname or personal reference instead of identifying information whenever possible.
You control your information. You may delete individual entries or request deletion of your account and associated personal information, subject to limited legal, security, fraud-prevention, and operational retention requirements.
Keep it private. Keep it discreet. Keep it yours.
1. Information We May Collect
Depending on how HoSko is used, we may collect, receive, store, or otherwise process the following categories of information:
- Account Information. Name or username, email address, account credentials, subscription status, account preferences, and other information associated with a HoSko account.
- User-Submitted Content. Photographs, identifiers or nicknames, ratings, notes, descriptions, general locations, expenses, experiences, rankings, and other information voluntarily entered into HoSko.
- Information About Other Individuals. Users may enter information relating to other adults. Users are responsible for ensuring they have a lawful basis and legal right to collect, possess, enter, upload, use, or otherwise process such information.
- Transaction Information. Subscription, billing, purchase, and payment-related information. Payment-card information may be processed directly by third-party payment processors rather than stored directly by HoSko.
- Device and Usage Information. IP address, device type, browser, operating system, login information, application activity, diagnostic information, security information, and similar technical data.
- Location Information. HoSko may process general, approximate, or user-entered location information necessary to provide geographic features. HoSko will not collect precise device location without appropriate notice, permission, or authorization where required by applicable law.
2. Sensitive Personal Information
Certain information processed through HoSko may constitute Sensitive Personal Information, sensitive data, or another specially protected category of personal information under applicable law.
Under Philippine law, Sensitive Personal Information includes specified information concerning an individual's race or ethnic origin, marital status, age, religious, philosophical or political affiliations, health, education, genetic or sexual life, certain legal proceedings, government-issued information, and other information specifically classified by law.
HoSko does not authorize users to collect, upload, store, disclose, or otherwise process another person's personal or Sensitive Personal Information merely because the information is publicly observable, available online, or otherwise known to the user. Users must have an appropriate lawful basis for processing such information and comply with applicable privacy and other laws.
HoSko prohibits content involving minors, human trafficking, coercion, exploitation, non-consensual sexual activity, non-consensual intimate imagery, stalking, harassment, threats, extortion, blackmail, doxxing, unlawfully obtained personal information, or other unlawful or prohibited content. HoSko may remove prohibited content and suspend or terminate accounts associated with violations.
3. How We Use Information
HoSko may use information to:
- Provide, maintain, and operate HoSko
- Create and maintain user accounts
- Calculate HoSko Scores, rankings, statistics, and related application features
- Save user preferences and permitted content
- Process subscriptions and payments
- Authenticate accounts and provide customer support
- Maintain application and account security
- Detect and investigate fraud, abuse, and prohibited activity
- Investigate privacy, safety, and content complaints
- Improve HoSko's functionality and user experience
- Maintain legitimate business and transaction records
- Comply with applicable legal and regulatory obligations
- Protect HoSko, its users, affected individuals, and others
HoSko will not use personal information for materially incompatible purposes without providing additional notice or obtaining consent where required by applicable law.
4. Lawful Processing
Where required by applicable law, HoSko will process personal information only when an appropriate lawful basis exists. Depending on the information, jurisdiction, and circumstances, the lawful basis may include consent, performance of a contract with the data subject, compliance with a legal obligation, protection of vital interests, legitimate interests where legally permitted, or another basis recognized under applicable law.
Sensitive Personal Information will be processed only where processing is permitted under applicable law and appropriate safeguards are implemented.
A HoSko user's acceptance of HoSko's Terms of Use does not constitute consent on behalf of another individual whose information that user enters into HoSko.
5. User-Generated Content
Users are responsible for information and content they submit to HoSko. Information appearing within HoSko should not be considered independently verified or factual merely because it appears within the application. Ratings, scores, notes, rankings, descriptions, and similar information may represent individual opinions or user-provided information.
Users must not knowingly submit materially false factual allegations, defamatory information, unlawfully obtained information, or content intended to threaten, exploit, intimidate, harass, embarrass, stalk, blackmail, or harm another individual. HoSko reserves the right to investigate complaints and restrict, anonymize, block, or remove content when appropriate.
6. Photographs and Likenesses
Photographs and likenesses of identifiable individuals may constitute personal information. Users may upload photographs only when they have a lawful right to possess and use the photographs for the intended purpose.
HoSko prohibits nude or sexually explicit photographs, non-consensual intimate imagery, exploitative imagery, photographs depicting anyone under 18, images obtained unlawfully, and images used in violation of another person's privacy, intellectual-property, publicity, or other legal rights. HoSko may restrict or remove photographs following a privacy, intellectual-property, safety, legal, or other legitimate complaint.
7. Privacy of Other Individuals
HoSko users should minimize personally identifiable information entered about another person. Where reasonably possible, users should use nicknames or non-identifying labels rather than full legal names.
Unless expressly permitted by HoSko and lawful under the circumstances, users should not enter another person's full legal name, home address, private telephone number, private email address, government identification information, financial information, workplace information, authentication credentials, or precise real-time location. The technical ability to enter information into HoSko does not constitute authorization from HoSko to collect or process that information unlawfully.
8. Data Minimization and Proportionality
HoSko seeks to collect and process only personal information reasonably necessary, relevant, adequate, and proportionate to legitimate and declared purposes. HoSko may restrict, remove, anonymize, aggregate, block, or delete information determined to be unnecessary, excessive, unlawfully processed, or inconsistent with the purposes of the service. Users are encouraged to avoid entering information unnecessary to the functionality being used.
10. Data Retention
HoSko retains personal information only for as long as reasonably necessary and legally permissible for the purposes for which it was collected or subsequently processed. Information may be retained as reasonably necessary to provide the service, maintain legitimate business records, prevent fraud and abuse, investigate complaints, resolve disputes, enforce agreements, protect safety, and comply with legal obligations. When information is no longer reasonably required, HoSko may securely delete, anonymize, aggregate, or otherwise dispose of it, subject to applicable legal requirements.
11. Information Security
HoSko maintains reasonable and appropriate administrative, organizational, physical, and technical safeguards designed to protect personal information against accidental or unlawful destruction, alteration, disclosure, misuse, loss, or unauthorized access. Safeguards may include encryption in transit, authentication, access controls, restricted administrative privileges, monitoring, backups, security procedures, and appropriate vendor controls. No internet-connected system or electronic transmission can be guaranteed to be completely secure.
12. Personal Data Breaches
HoSko maintains procedures designed to identify, investigate, contain, and respond to personal-data security incidents. Where a personal data breach triggers notification requirements under applicable Philippine or United States law, HoSko will provide notifications to affected individuals, the National Privacy Commission, other regulatory authorities, or other parties as required by applicable law.
13. Your Privacy Rights
Depending upon your location and applicable law, you may have rights concerning personal information relating to you, including rights to:
- Be informed about processing
- Access personal information
- Correct or rectify inaccurate or incomplete information
- Request deletion, erasure, removal, or blocking of qualifying information
- Object to certain processing
- Restrict or limit certain processing
- Withdraw consent where processing relies upon consent
- Obtain qualifying information in a portable format where applicable
- Opt out of certain sales, sharing, targeted advertising, or profiling where applicable
- Limit certain uses of sensitive information where applicable
- Seek applicable remedies or damages
- File a complaint with an appropriate privacy regulator
HoSko will not unlawfully discriminate against an individual for exercising applicable privacy rights.
14. Individuals Listed or Depicted in HoSko
You do not need to have a HoSko account to exercise applicable privacy rights concerning information about you. If you believe your photograph, likeness, identity, nickname, location, ratings, notes, descriptions, or other personal information has been entered into HoSko, you may request that HoSko review the information and, where applicable, access, correct, restrict, block, or delete qualifying information.
15. Non-Consensual Intimate Content
HoSko prohibits non-consensual intimate imagery and sexually explicit photographs. If you believe prohibited intimate content depicting you has been uploaded or processed through HoSko, immediately contact safety@GetHoSko.com. HoSko will prioritize legitimate reports involving non-consensual intimate imagery and take action consistent with applicable law.
16. Minors
HoSko is exclusively an adults-only service. You must be at least 18 years old to create an account or use HoSko. Individuals under 18 may not knowingly be entered as profiles, depicted, rated, reviewed, or otherwise included in HoSko content. If HoSko learns that information concerning a minor has been submitted, HoSko may immediately restrict or remove the information and suspend or terminate the responsible account. Suspected content involving a minor should immediately be reported to safety@GetHoSko.com.
17. International Data Transfers
HoSko may utilize service providers or technical infrastructure located outside the country in which personal information was originally collected. Where required by applicable law, HoSko will implement appropriate contractual, organizational, technical, or other safeguards governing international transfers and processing. HoSko remains accountable for personal information under its control or custody as required by applicable law.
18. Philippine Data Privacy Act
Where applicable, HoSko, LLC processes personal data in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, and applicable issuances of the National Privacy Commission of the Philippines. The Philippine Data Privacy Act may apply to processing occurring outside the Philippines where statutory requirements concerning Philippine citizens or residents and an entity's links with the Philippines are satisfied.
HoSko recognizes the Philippine principles of transparency, legitimate purpose, proportionality, lawful and fair processing, data minimization, accountability, and appropriate security. Philippine law provides heightened protection for Sensitive Personal Information. HoSko recognizes that certain information concerning an individual's sexual life constitutes Sensitive Personal Information under the Data Privacy Act.
Where HoSko, LLC acts as a Personal Information Controller, HoSko will process covered personal information only where an appropriate lawful basis exists and will maintain appropriate safeguards for personal information under its control or custody. Where consent is relied upon, consent must satisfy applicable Philippine requirements. The fact that information was submitted by a HoSko user does not by itself establish the consent of another individual described or depicted in that information.
Subject to applicable law, Philippine data subjects may exercise rights including the right to be informed, right to object, right to access, right to rectification, right to erasure or blocking, right to data portability, right to damages where provided by law, and right to file a complaint with the National Privacy Commission. Individuals may also submit qualifying complaints directly to the National Privacy Commission of the Philippines.
19. United States Privacy Rights
Residents of certain U.S. states may have additional privacy rights under applicable state privacy laws. Depending upon the jurisdiction, applicability of the law, and nature of the processing, these may include rights to know or access personal information, correct inaccurate information, delete qualifying information, obtain portable copies of information, opt out of certain sales or sharing, opt out of certain targeted advertising or profiling, restrict certain processing of sensitive information, appeal certain privacy-request decisions, and receive protection against unlawful discrimination for exercising privacy rights. HoSko will honor qualifying requests as required by applicable law.
20. California Privacy Rights
Where the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), applies, California residents may have additional rights concerning qualifying personal information. Depending upon applicability and circumstances, these may include rights to know, access, correct, delete, obtain information concerning categories of personal information collected or disclosed, opt out of qualifying sales or sharing, and limit certain uses or disclosures of sensitive personal information. HoSko will provide legally required mechanisms for exercising these rights if and when applicable to HoSko's processing activities.
21. Legal, Regulatory, and Safety Disclosures
HoSko may preserve, restrict, or disclose information where reasonably necessary to comply with applicable law, valid legal process, court orders, subpoenas, regulatory requirements, or lawful government requests. HoSko may also take appropriate action when reasonably necessary to investigate or address suspected human trafficking, exploitation, abuse, threats to safety, fraud, non-consensual content, or other unlawful conduct. Nothing in this Privacy Policy requires HoSko to disclose information where disclosure would violate applicable law or adversely affect another person's privacy or legal rights.
22. Third-Party Services
HoSko may contain links to or integrate with third-party websites, payment processors, applications, or services. Those third parties may maintain their own privacy practices and policies. HoSko is not responsible for independent third-party privacy practices except to the extent responsibility cannot lawfully be excluded. Users should review applicable third-party privacy policies before providing information directly to those services.
24. Changes to This Privacy Policy
HoSko may periodically update this Privacy Policy to reflect changes in the service, technology, business practices, legal requirements, or privacy practices. The Last Updated date at the beginning of this Policy identifies the most recent revision. Where required by applicable law, HoSko will provide additional notice or obtain appropriate consent before materially different processing begins.
